Terms of Service

1. Acceptance of Terms

By accessing or using FlyorBook ("the Service"), operated by Prime360 Holding Ltd. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

FlyorBook is a flight booking marketplace that provides real-time pricing, target-price bidding with auto-book, model-based price intelligence, saved-profile checkout, express booking for imminent departures, and flight risk scoring. We act as an intermediary between users and airlines, facilitating the search, comparison, and purchase of airline tickets.

Our five core features include:

  • Airport Mode — geolocation-based discovery of nearby departing flights within 60–90 minutes
  • Target-Price Auto-Book — provider price checks with automatic booking when your target price is met
  • Price Intelligence — model forecasts, trend analysis, and price alerts
  • Saved-Profile Checkout — booking with saved passenger profiles and payment methods
  • Flight Risk Score — delay probability ratings (LOW/MEDIUM/HIGH) with safer alternative suggestions

3. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use the Service. By creating an account, you represent and warrant that all information you provide is accurate, current, and complete. The Service is not available to users in jurisdictions where online flight booking services are prohibited by law.

4. User Accounts

To access certain features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials and API keys
  • All activities that occur under your account, including auto-book transactions
  • Providing and maintaining accurate, complete account information
  • Notifying us immediately at support@flyorbook.com of any unauthorized access
  • Maintaining only one account per person — duplicate accounts may be terminated

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for more than 24 months.

5. Booking and Payments

When you make a booking through FlyorBook:

  • You agree to pay the displayed price at the time of booking confirmation
  • Flight fares are live provider offers and may change or expire before payment is completed; a fare is only secured when the airline order is confirmed
  • Hotel/stay pre-authorization holds (where offered) revalidate price before capture and do not guarantee airline inventory
  • Standard flight checkout uses Duffel Payments; express, subscriptions, and some other flows use Stripe (PCI DSS Level 1)
  • Prices may be shown in the offer currency from the airline provider (not always USD)
  • A tiered service fee per booking applies in addition to the flight ticket price ($12 for fares under $200, $20 under $600, $28 under $1,200, $38 for $1,200+)
  • Your booking commission rate depends on your subscription tier (2.5% Free, 1.5% Pro)

6. Target-Price Bidding

Our target-price bidding feature allows you to set a desired price for a flight route. By using this feature:

  • Bids are monitored until they are triggered, cancelled, or expire
  • If auto-book is enabled, your saved payment method will be charged automatically when your target price is met
  • Bids expire after the specified duration (default 24 hours, up to 3 days on Free and up to 30 days on Pro)
  • We do not guarantee that prices will reach your target — bids may expire unfulfilled
  • Free tier users may have up to 1 active bid; Pro tier users may have up to 20
  • You may cancel an active bid at any time before it triggers, at no charge
  • Auto-book is a Pro-tier feature; Free-tier bids receive notifications only

7. Express Booking and Airport Mode

Airport Mode shows nearby flights departing in the next 60–90 minutes. Express Booking enables rapid booking of flights departing within 15–60 minutes:

  • Airport Mode uses your device's geolocation (with your explicit consent) to identify nearby airports
  • Express bookings are designed for imminent departures; airline check-in remains the traveler's responsibility
  • A booking travel document is available after the airline order is confirmed
  • Due to the time-sensitive nature, express bookings are generally non-refundable (see our Refund Policy)
  • You must ensure you can physically reach the departure gate in time — FlyorBook is not liable for missed flights

8. Price Intelligence and Predictions

Our ML-powered price intelligence features provide trend analysis, price predictions, and buy/wait recommendations. These predictions are generated using aggregated, anonymized search data and historical pricing patterns. They are for informational purposes only. We do not guarantee the accuracy of any prediction and are not liable for booking decisions made based on our predictions or trend indicators.

9. Flight Risk Scores

Every flight search result includes a risk assessment (LOW, MEDIUM, or HIGH) based on historical delay data, weather patterns, and airline on-time performance. Risk scores are informational only and do not constitute a guarantee of flight performance. Safer alternative suggestions are recommendations, not guarantees of on-time arrival. FlyorBook is not responsible for flight delays, cancellations, or disruptions regardless of the displayed risk score.

10. Subscription Plans

FlyorBook offers Free and Pro subscription tiers:

  • Free tier: core features with usage limits (1 bid, 3 alerts, 100 searches/day, 2.5% commission)
  • Pro tier ($9.99/month or $99.99/year): expanded limits, auto-book, ML predictions, priority support, API access, 1.5% commission
  • Pro subscriptions auto-renew at the end of each billing cycle unless cancelled
  • You may cancel at any time; access continues through the end of your paid billing period
  • Upgrading mid-cycle is prorated; downgrading takes effect at end of current period
  • 30-day cooling-off refund on Pro subscription fees only (not flight or hotel tickets)

11. Cancellations and Refunds

Flight cancellation and refund policies are governed by the respective airline's terms and the fare type purchased. FlyorBook facilitates refund requests but does not control airline refund decisions. Please review our Refund Policy for complete details, including the 24-hour cancellation window, express booking policies, and subscription refunds.

12. User Conduct

You agree not to:

  • Scrape, crawl, or harvest data from the Service without prior written permission
  • Use automated tools to access the Service except through our official API with a valid API key
  • Make fraudulent bookings, use stolen payment methods, or misrepresent your identity
  • Circumvent rate limits, security measures, or access controls
  • Interfere with or disrupt the Service infrastructure, servers, or connected networks
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Resell or commercially redistribute flight data, prices, or predictions without a written license agreement

13. Intellectual Property

All content, trademarks, logos, UI/UX designs, algorithms, ML models, and software comprising the Service are the exclusive property of Prime360 Holding Ltd. or its licensors. You may not copy, modify, distribute, reverse-engineer, or create derivative works without our prior written consent. Your use of the Service grants you no ownership rights in any intellectual property. The FlyorBook name, logo, and all related marks are registered trademarks of Prime360 Holding Ltd..

14. Limitation of Liability

To the maximum extent permitted by applicable law, Prime360 Holding Ltd. and its officers, directors, employees, and agents shall not be liable for:

  • Flight delays, cancellations, overbookings, or schedule changes made by airlines
  • Losses resulting from price prediction inaccuracies or trend analysis errors
  • Technical issues preventing bookings or bid triggers
  • Missed flights due to express booking timing or airport mode geolocation inaccuracies
  • Any indirect, incidental, special, consequential, or punitive damages arising from use of the Service

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees you paid to FlyorBook in the 12 months preceding the event giving rise to the claim. This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise).

15. Indemnification

You agree to indemnify, defend, and hold harmless Prime360 Holding Ltd. and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

16. Dispute Resolution

If you have a dispute with FlyorBook, you agree to first attempt informal resolution by contacting us at legal@flyorbook.com. We will attempt to resolve the dispute within 30 days. If informal resolution is unsuccessful, any remaining dispute shall be resolved through binding arbitration administered under the rules of the Malta Arbitration Centre (MAC) in Malta.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Prime360 Holding Ltd.. Claims must be brought in an individual capacity only.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malta, without regard to conflict of law principles. Any legal proceedings not subject to the arbitration clause above shall be brought exclusively in the courts of Malta, and you consent to the personal jurisdiction of such courts.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email or a prominent notice on the Service. Your continued use after the effective date of the changes constitutes acceptance of the updated Terms. If you disagree with any changes, you must discontinue use and close your account.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
